O Visa

An O-1 visa is reserved for an individual that, under INA § 101(a)(15)(O), has extraordinary ability in the sciences, arts, education, business, or athletics which has been demonstrated by sustained national or international acclaim or, with regard to motion picture and television productions, a demonstrated record of extraordinary achievement, and whose achievements have been recognized in the field through extensive documentation, and seeks to enter the United States to continue work in the area of extraordinary ability.

An O-2 visa is for an individual who enters the U.S. temporarily in order to assist in the artistic or athletic performance by an O-1 alien who is admitted for a specific event or number of events. See § INA 101 (a)(15)(o)(ii)(I). In order to qualify for the O-2 visa, the alien must be an integral part of the performance and have critical skills and experience with the O-1 alien which are not of a general nature and which cannot be performed by other individuals. INA § 101(a)(15)(O)(ii)(II).

With respect to motion picture or television production, the O-2 alien must have skills and experience with the O-1 alien which are not of a general nature and which are critical either based on a pre-existing long-standing working relationship or, with respect to the specific production, because significant production (including pre- and post-production work) will take place both inside and outside the United States and the continuing participation of the alien is essential to the successful completion of the production, and must have a foreign residence which the alien has no intention of abandoning. See INA §§ 101(a)(15)(O)(ii)(III)(b) and 101(a)(15)(O)(ii)(IV).

O-3 visas are available for the spouse and children of the O-1 and O-2 aliens. The period of authorized stay for an approved petition will depend on the length of time necessary to accomplish the event, but is no more than 3 years.
