The K-1 visa is a non-immigrant visa that allows an alien fiancé(e) to enter the U.S. to marry their U.S. citizen fiancé(e). The alien’s unmarried children under the age of 21 may also enter the U.S. with the alien as they will be issued K-2 visas.

In order to file a petition for a K-1 visa, (1) you (petitioner) must be a U.S. citizen; (2) you and your fiancé(e) must intend to marry within 90 days of your fiancé(e) entering the United States; (3) you are both free to marry; and (4) you have both met in person within two years before filing of the petition, unless this would violate strict and long-established customs of you or your fiancé(e)’s foreign culture or social practice, or the requirement would result in extreme hardship to you.

Once your fiancé(e) enters the United States and you are married, you may then file an Application to Register Permanent Residence or Adjust Status so that your spouse will obtain legal permanent resident status.
